Terms of Service

These terms govern your use of the HudumaSMS platform. By creating an account or sending messages through the service, you agree to them.
1. Who we are
These terms are an agreement between you and HudumaSMS ("we", "us", "our"). HudumaSMS operates a bulk SMS platform for senders in Tanzania, available at hudumasms.com with the customer dashboard at sms.huduma.cloud.

2. Your account
You must give accurate registration details and keep your password secure. You are responsible for everything sent from your account. Tell us immediately if you believe someone else has gained access to it.
One person or organisation, one account. We may suspend accounts that are shared to evade sending limits or pricing tiers.
3. Credits and payment
The service is prepaid. You buy SMS credits in advance and each message consumes credits at the rate for your pricing tier at the time of sending. Current rates are shown on our pricing page and in your dashboard.
- Credits do not expire. Unused credits remain on your account for as long as the account is open.
- A long message is split into multiple parts and each part costs one credit. Messages using non-GSM characters are limited to 70 characters per part instead of 160, so they cost more credits for the same text.
- Credits are consumed when a message is accepted by the network for delivery. We refund credits for messages we fail to submit.
- Credits are not refundable for cash and cannot be transferred between accounts, except at our discretion.
4. Sender IDs
Messages are sent under a sender ID that must be registered with us and approved before use. You may only register a sender ID that represents a name, brand, or organisation you are entitled to use. We reject or withdraw sender IDs that appear to impersonate someone else.
Sender IDs are subject to the rules of the mobile networks and the Tanzania Communications Regulatory Authority (TCRA), which may refuse or revoke one at any time. Approval by us is not a guarantee that a network will carry it.
5. Acceptable use
You must not use the service to send:
- messages to people who have not consented to receive them, or who have asked you to stop;
- fraudulent, deceptive, or phishing content, including messages that impersonate a bank, mobile money service, government body, or any other organisation;
- content that is unlawful in Tanzania, threatening, harassing, or that incites violence or hatred;
- unsolicited marketing to numbers obtained from a third party without a lawful basis, or to purchased or scraped lists;
- anything that breaches TCRA rules or the terms of the mobile networks.
You must honour opt-out requests promptly and keep records showing that your recipients consented. We may suspend sending, without notice, where we reasonably believe this section is being breached — including where a network or regulator requires us to.
6. Delivery
We pass your messages to mobile networks through one or more delivery partners. We do not control those networks and cannot guarantee delivery, delivery time, or delivery reports. Figures we publish about delivery rates describe past performance and are not a commitment.
Messages may be delayed or blocked by a network for reasons outside our control, including congestion, handset state, number portability, and network filtering.
7. Service availability
We aim to keep the service available continuously, but we do not promise uninterrupted access. We may suspend it for maintenance, and we will give notice where reasonably possible.
8. Your data and your recipients' data
How we handle personal data is set out in our Privacy Policy. In short: for your account data we act as the controller, and for the contacts and message content you upload we act on your instructions as a processor. You are responsible for having a lawful basis to send to the people on your lists.
9. Suspension and termination
You may close your account at any time. We may suspend or close an account that breaches these terms, that is used unlawfully, or where required by a network or regulator. Where we close an account for a reason other than your breach, we will discuss unused credits with you.
10. Liability
Nothing in these terms excludes liability that cannot be excluded under Tanzanian law. Subject to that, we are not liable for indirect or consequential loss, loss of profit, business, or goodwill, and our total liability in any twelve-month period is limited to the amount you paid us in that period.
11. Changes
We may update these terms. Where a change materially affects you, we will notify you by email or in the dashboard before it takes effect. Continuing to use the service after that means you accept the updated terms.
12. Governing law
These terms are governed by the laws of the United Republic of Tanzania, and the courts of Tanzania have exclusive jurisdiction over any dispute arising from them.
